Under this law, married, unmarried, single, and LGBTQIA+ intended parents—including international families—can pursue surrogacy in New Jersey with confidence. The statute requires that all gestational carrier agreements be in writing, executed before medical procedures, and that each party has independent legal counsel. Both the intended parents and the gestational carrier must also undergo medical and mental health evaluations before entering into the agreement.

 

New Jersey courts routinely grant pre-birth parentage orders, confirming the intended parents as the legal parents before delivery. This ensures that their names appear directly on the child’s birth certificate, eliminating the need for post-birth adoption or additional legal steps. These parentage orders are recognized statewide, creating a predictable and secure legal process that allows intended parents to focus on preparing for their baby’s arrival.
