Gestational surrogacy is considered legal in Florida when the proper legal documents and protocol are followed. Requirements include:

  • Having a written surrogacy contract in place before the pregnancy begins. This contract outlines: who is responsible for payments during the surrogacy, that the surrogate will give up parental rights after the baby is born, that the intended parents will become the legal parents, and who is responsible for medical decisions. 

  • Meeting statute guidelines outlines for surrogates and intended parents. While the law is favorable for married couples with a genetic link to the baby, other family dynamics can pursue surrogacy, however the legal process may involve additional steps with the courts.

  • Parentage is established after birth through the court. Post-birth parentage order to recognize the intended parents as the legal parents (not the surrogacy, who may be listed as the ‘birth mother’ at the hospital) and the birth certificate is updated relinquishing the surrogate of parental rights.

  • Be a U.S. citizen or permanent resident

  • Be between 21–38 years old

  • Have had at least one prior healthy pregnancy (maximum five), with no major complications

  • Had no more than two C-sections

  • Have a BMI under 32.

  • Not be currently using tobacco or recreational drugs, or taking depression/anxiety medications.

 

These requirements are in place to protect your health and ensure the best possible outcome for everyone involved.

In Florida, gestational surrogacy is legal and safe with the proper documentation and agreements in place.
