Despite the limitations on compensated surrogacy, Nebraska’s courts recognize the intent and best interests of the child when establishing legal parentage. In most cases, the woman who gives birth is considered the legal mother at birth, and her spouse—if married—is presumed to be the legal father. Therefore, intended parents typically need to obtain a post-birth parentage or adoption order to be legally recognized as the child’s parents and to have their names added to the birth certificate.
